A Bradford county woman has filed a lawsuit against Chesapeake Appalachia, LLP, Chesapeake Energy Corporation, and Nomac Drilling LLC alleging that her well water was contaminated due to improper natural gas drilling operations. She is represented by Richard J.
According to the lawsuit, because of improper natural gas drilling activities by the defendents, methane, ethane, barium and other harmful substances were allowed to enter and contaminate the victim’s water supply. In the lawsuit, the victim claims that she suffers dermatitis, gastrointestinal discomfort, barium poisoning, pain, numbness to her face and hands, deformities of the bones of her hands, headache, and other injuries due to exposure to harmful substances. Additionally, the suit alleges that the value of her property has diminished, she has lost the use and enjoyment of her property, and has suffered a drop in the quality of life she otherwise enjoyed.

The lawsuit seeks to bar the defendants from continuing to engage in these practices, and seeks compensatory damages, punitive damages and the cost of future health monitoring for the victim.

Neblett, Beard & Arsenault is experienced in handling environmental lawsuits, having worked hard for victims of numerous oil and gas operations across Louisiana and the nation, including this year’s devastating Gulf of Mexico oil spill.

Four people from died after an 18 wheeler lost control, crossed the median and slammed head on into their pickup, Louisiana State Police said.

The 18-wheeler, marked with the company name Texas International Express LLC, was traveling north about 5 miles north of Pearl River when its front left tire blew out, said Trooper Nick Manale, spokesman for State Police Troop L. The driver, Juan Torres, 37, of Montgomery, Texas, lost control of the rig, and the tractor-trailer rumbled across the median and struck the southbound pickup nearly head-on, police said. After impact, the pickup and 18-wheeler slid off the highway, coming to a halt in the treeline on the west side of the interstate, Manale said.

Troopers specializing in vehicle inspection were brought in to determine whether the 18-wheeler had all of the required equipment and whether that equipment was properly installed, police said. Federal Motor Carrier SafetyRegulations require an 18-wheeler driver to perform a pre-trip inspection and a end of the day report. A driver cannot operate a commercial motor vehicle until he has inspected his equipment including the tires for good working order.

§392.7 Equipment, inspection and use.

No commercial motor vehicle shall be driven unless the driver is satisfied that the following parts and accessories are in good working order, nor shall any driver fail to use or make use of such parts and accessories when and as needed:

Check out our new press release -

Alexandria, LA (PRWEB) July 1, 2010 — The U.S. Food and Drug Administration should adopt a proactive approach to food safety such as the one outlined in a new report by the Institute of Medicine and National Research Council, says Louisiana food safety advocate Richard J. Arsenault.

The 500-page report, requested by Congress 18 months ago after a rash of foodborne illness outbreaks, states that the FDA’s current “reactive” model makes inefficient use of its limited resources and relies on a case-by-case approach to gathering and using information on risks.

By switching to a “risk-based” approach outlined in the report, the FDA could better identify problems in the food supply and distribution chain, efficiently direct resources to high-risk areas and catch problems before they turn into widespread outbreaks, the report says.

“More than 300,000 people need to be hospitalized and over 5,000 people die from foodborne illness in America every year, and that number of victims is unacceptable when many of these illnesses could have been prevented,” says Arsenault, whose firm, Alexandria-based Neblett, Beard & Arsenault, has represented hundreds of foodborne illness victims throughout Louisiana and across the country.

“The IOM report, for the most part, sets out a vision for how local, state and federal officials can work together to catch problems before they spread and harm innocent consumers, and I think Congress and the FDA should give serious consideration to its recommendations,” Arsenault says. “It’s not a perfect plan, but it serves as a good blueprint.”

The FDA is charged with ensuring the safety of approximately 80 percent of the nation’s food supply, including seafood, fruits, vegetables and dairy products. The federal agency shares food safety responsibility with the U.S. Department of Agriculture, which oversees meat, poultry and egg products, as well as state and local agencies, which inspect food production facilities.

According to the IOM report, the FDA needs to adopt a system that would increase coordination with those other agencies, and it needs more authority to carry out its mission through amendments to the federal Food, Drug and Cosmetic Act – much of which is currently contained in proposed legislation before the Senate.

The report calls for establishing a centralized food safety data center that would collect information, quickly assess risks and take steps to address food safety problems without competing with other agencies for resources.

To enhance its efficiency, the FDA could also delegate food facility inspections to states and establish national standards for the intensity and frequency of those reviews, the report says.

According to the report, this change would build on current practices in which roughly 60 percent of inspections are already conducted by state inspectors, and it would increase the quality of inspections and avoid duplication of efforts.

The report also asks Congress to consider legislation that would specify the FDA’s authority in facility registration, preventive controls, risk-based inspection, mandatory recall, reporting of adulteration and banning of certain food imports if the public’s health is at risk.

“What is significant to me about this report is that a committee of experts has clearly stated that our current food safety system is inadequate and in dire need of change,” Arsenault says. “Improvements need to be made.”

Jurors in Colorado ruled that Time Insurance d/b/a Assurant Health must pay $37 million to a former preschool teacher for cancelling her health insurance after she was seriously injured in a car accident. Time/Assurant refused to pay approximately $185,000 in medical bills from the accident and cancelled the woman’s policy. The insurance company’s “excuse” was that she failed to disclose a previous emergency room visit for shortness of breath. Jurors obviously didn’t buy it.

After the debilitating accident, the Colorado woman was left unable to return to work and now supports her four children on Social Security disability payments.

This is just one example of the arrogance of insurers nationwide who want to cherry pick who they cover and arbitrarily look for excuses to cancel coverage in the middle of serious illnesses or injuries- just at the time you need your coverage the most! Kudos to the Colorado jurors for making the insurers pay a heavy price for their ill-advised actions. If more jurors will make similar gutsy rulings, insurance companies will be forced to deal with all of us in the fair manner we all deserve and expect.

The results of our national driving test are in and we Bayou Staters should be ashamed! Louisiana drivers scored 46th in the nation for their driving knowledge, with almost a third of the respondents failing the annual GMAC Insurance National Drivers Test. Louisiana drivers had an average score of 74.1 percent (70 percent or higher is a passing score) and 31.1 percent of Louisiana respondents failed the test. Sadly our poor scores reflect a decrease in good driving knowledge and habits. In 2009, we as a state ranked 37th.

The sixth annual national test gauges driver knowledge by administering 20 questions taken from state Department of Motor Vehicles exams. Kansas drivers ranked first in the nation (82.3 percent average score); New York drivers ranked last (70 percent average score).

Overall, the test scores indicate a large number of licensed American drivers continue to lack knowledge of basic rules of the road. Eighty-five percent could not identify the correct action to take when approaching a steady yellow traffic light, and many remained confused by the appropriate safe following distances. Is it any wonder that car accidents, especially those involving serious injuries and fatalities continue to be a serious problem? With this number of ill-prepared drivers we certainly cannot expect insurance rates to decline anytime in the near future.

We need to wake up to these realities and formulate better training for young drivers, stricter testing for new drivers and elderly drivers with health issues, as well as re-training for drivers who have a record of causing multiple auto accidents which involve injuries to others.

A car accident involving an SUV and an 18-wheeler has killed one woman and critically injured the male driver. The accident happened around 6 PM in the east bound lanes of I-20 just east of Industrial Drive in Bossier City.

Preliminary investigation suggest that an 18-wheeler with a flat bed trailer was pulled over onto the shoulder of the road out of the lanes of traffic when an SUV that was proceeding east bound on the outside lane drifted off onto the shoulder and rear ended the 18-wheeler. The two occupants inside the SUV sustained life threatening injuries. The female passenger was airlifted to LSUMC where she was later pronounced dead. Her name has not yet been released pending notification of her family. The driver of the 18-wheeler was not injured.

The investigation should include why the 18 wheeler was on the shoulder of the interstate. Was it creating a danger for motorist? Did the 18 wheeler driver properly display warning devices for a his tractor/trailer on the shoulder? The Federal Motor Carrier Safety Regulation Part 392.22: “Emergency signals; stopped commercial motor vehicles” require the 18-wheeler driver to take immediate steps to protect the motoring public. .

Sen. Robert Adley (R-Benton), with the enthusiastic backing of the Louisiana Chemical Association, has filed legislation which would limit types of lawsuits filed by law clinics that receive state funds. The bill would make the Legislature overseer of the law clinics and put the future role of university law clinics up in the air.

Adley’s bill would forbid law clinics at both public and private colleges from suing governmental agencies, individuals and businesses for financial damages or raising constitutional issues. The clinics give college law students real-world experience while working free of charge on behalf of the public.

In the past, the Tulane University law clinic has opposed the oil, gas and utilities sector on issues of environmental regulations and violations.

One has to wonder if Senator Adley’s motives are actually his own or that of his financial backers in the well-heeled energy field. Muzzling free speech and the activities of the well-intentioned law clinics is ill-advised, and smacks of a longtime politico doing the bidding of a powerful industry which does not want inquiries into its dumping of hazardous waste and byproducts into our state’s fragile environment and ecosystems.

Our legislature has a track record of passing legislation that benefits the business community and some of the wealthiest corporations at the expense of rights of injured employees, victims of negligence and hazardous activities without adequate recourse to recover their damages.

Texas DPS say that traffic along I-30 was at a near crawl because of ongoing construction.

DPS reports that the driver of an 18-wheeler approached the construction zone and failed to slow down and ended up barreling through six vehicles before running off the road. Was the 18-Wheeler exceeding hours of service? Fatigued? Texting or email?

A total of 10 people were reportedly involved in the accident and 3 of the 10 were taken to an area hospital with what’s being described as serious injuries. Texas DPS reports that the three transported were in the first vehicle hit by the 18-wheeler.

Nationwide motorcycle fatalities are expected to drop to 4762 from 5290.

Reasons for Louisiana’s increase may include the brief absence of a motorcycle safety program offered by the state. An estimated 2000 people took the course when offered by the Department of Education. Other reasons include a longer riding season than states with harsher seasonal weather and a higher number of alcohol-related motorcycle deaths.

Motorist also have to keep a vigilant outlook for the much smaller motorcycle. Increased awareness of approaching motorcycles and the elimination of distractions such as text messaging and cell phone will help the driver of a car visualize the motorcycle before it is too late to avoid a crash.

Food Safety Law Firm Investigates Major Outbreak Of E. coli Linked To Lettuce

Richard J. Arsenault of Neblett, Beard & Arsenault in Alexandria, Louisiana, says the latest cases of food poisoning undermine public confidence in our nation’s food supply.

As another outbreak of E. coli spreads across the nation, prompting a multistate recall of lettuce products, a nationally known law firm involved in food safety litigation has called for stricter enforcement of food processing rules and regulations.

“E. coli in any food product is unacceptable, and once again we’re seeing an outbreak in a popular and widely distributed food item,” said food safety lawyer Richard J. Arsenault, founding partner at Neblett, Beard & Arsenault in Alexandria, Louisiana.

“This type of recall undermines the public’s confidence in our food supply,” Arsenault said. “It’s imperative that the safety of our food become a top priority.”

On May 6, the U.S. Food and Drug Administration announced a multistate recall of shredded romaine lettuce sold by Freshway Foods of Sidney, Ohio. Tests run by the New York State Public Health Laboratory in Albany discovered the presence of the E. coli 0145 in a package of romaine lettuce.

The recalled romaine lettuce was sold to wholesalers, restaurants, delis, and institutions under the brand names Freshway and Imperial Sysco — in the following states: Alabama, Connecticut, the District of Columbia, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Virginia, West Virginia and Wisconsin.

Consumers who purchased romaine lettuce from in-store salad bars and delis including those at Kroger, Giant Eagle, Ingles Markets, and Marsh stores in the states previously listed should throw the product away, according to a recall notice on the FDA site. Bulk, prepackaged romaine or bagged salad mixes containing romaine that were purchased in supermarkets are not included in the recall; Freshway Foods does not produce those products, according to the FDA.

So far, victims of the illnesses are mostly college students in Ohio, Michigan and New York, but the outbreak may expand as the recall spreads public awareness of the hazard. As of May 7, there are 19 individuals that have become ill from E. coli O145 with as many as ten other illnesses the CDC suspects are linked. Many of the victims have been hospitalized and three of the victims have developed hemolytic uremic syndrome (HUS), a life threatening complication. The food safety attorneys at the law offices of Neblett, Beard & Arsenault are currently investigating claims on behalf of E. coli victims who believe their illnesses are part of this multistate outbreak.

Fruits and vegetables, like romaine lettuce, can carry pathogens from the soil or water, or become contaminated during processing. Leafy greens are the produce most often associated with foodborne illness. It is not yet known how the lettuce may have become contaminated with E. coli 0145.

“E. coli” is part of a diverse group of bacteria, many of which are harmless or even beneficial; however, shiga toxin-producing strains like E. coli 0145 and E. coli 0157 can be dangerous. These serotpes produce a poison that can cause the blood to improperly clot resulting in organ failure.

“While studies show that outbreaks of E. coli 0157:H7 are on the decline, it is troubling to think that outbreaks linked other E. coli strains could be taking O157’s place,” concluded Arsenault.
