Under Louisiana workers compensation law, you have one (1) year from the date of your work injury to file suit in workers comp court. If your employer has been paying your workers comp wage benefits, then you have a year from the last payment of wage benefits to file suit. If your employer has paid for medical treatment for your work injury, then you have three (3) years from the date of the last payment to file suit.
If you got hurt at work, we recommend sticking with the hard and fast rule of filing within one (1) year of your date of accident. Call an experienced workers compensation lawyer for more information and more questions regarding possible claims against your employer.
